USAGE POLICY

1. Introduction

“Alkashray” (“Alkashray/we/us”) is an arm of Manoprem trust whose objective is to provide a leisure place for seniors [i.e. persons aged 60 (sixty) years and above before the Check-in date]. Alkashray is situated in the valley of Surur in the beautiful Sahyadri ranges and is merely 1.5 (one and a half) hour distance from Pune and 4.5 (four and a half) hour distance from Mumbai.

2. Applicability

This Policy is applicable to all those who wish to avail the services offered by Alkashray. We reserve the right to update the Policy from time to time. You and the person/s accompanying you (who may or may not be related to you) will be referred to as “you/guests” collectively, irrespective of the number of people. The said age criteria of 60 years and above need not apply to the partner.

3. Booking Form

It is mandatory to fill and submit a booking form for the booking process either manually or online. The person making the booking/s shall be 18 years and above. You shall be allowed to avail our services only after you have filled the form and the same has been accepted by Alkashray. You agree not to misrepresent and misstate any facts in the booking form and we reserve the right to verify all the information provided in the said booking form. You shall not be permitted to make changes and/or alter any information in the said booking form subsequent to submitting the said booking form. It shall be deemed that all the information provided by you in the booking form is true and correct and in the event it is found that the information provided by you in the booking form is untrue and false then we may cancel your booking or take appropriate action against you as we may deem fit. You authorise us to use any information provided in the booking form for our official and internal purposes.

4. Bookings

We reserve the right to cancel your booking based on your medical conditions at the time of arrival or any time thereafter and you agree that Alkashray’s decision shall be final and binding and shall not be subject to challenge or dispute of any kind. Further, you agree to make no communication either verbal or non-verbal nor make any visits to the Alkashray’s management regarding the determination of the cancellation. We shall not be liable for any cancellations made on the booking. You agree to be fully responsible for any cancellations made on the booking. You agree that you will co-operate and assist us for any and all further queries regarding the booking of rooms and other services provided by us, if any. You may ask for preference of rooms, subject to availability. We also reserve the right to modify the bookings of rooms and other services as per the availability and the sole discretion of Alkashray without any recourse to you. You may be permitted to modify your bookings depending on the availability at Alkashray and may be charged extra. All bookings made with us are non-transferable.

5 Waiting List

We understand that Alkashray provides impressive services and considering the availability of rooms at the relevant time, we offer the waiting list option. In the event the rooms are booked during the duration you wish to avail our services, you can still bookmark the same or send us an enquiry and we will get back to you if there is any vacancy or availability of rooms.

6. Charges

On check-in and/or at the time of booking at Alkashray you shall make payment of the entire booking amount through any acceptable mode of payment as listed herein .
We may charge you a refundable security deposit for incidental expenses which will be refunded in 7 business days.
In the event of any damage to the property caused by you or any of the guests staying in your room, including the driver if any; then the amount will be adjusted from this security deposit for the charges and the balance amount will be refunded to you.
In the event that the damage/loss caused is greater than the amount of the security deposit, then you authorise alkashray to charge you for the excess amount accordingly.
Your online booking will be confirmed on the receipt of full payment by Alkashray .
The acceptable modes of payment are

internet banking
UPI
Demand Drafts

[If you submit a Demand Draft, you are requested to provide your bank account information for refund, if any.]

The acceptable modes of payment do not include cash and cheques.

You hereby declare that any credit or debit card used by you for payment shall meet the following criteria-

The card shall be active and not have expired and should be a valid credit or debit card issued by a recognized financial institution,
The card shall have sufficient funds for payment of the services availed and
The card shall not have been stolen or otherwise give rise to any civil or criminal liability or proceedings
You are permitted by the owner of the card to make payments by the said card.

You agree and understand that payment mechanisms may be governed by separate or additional terms of use prescribed by us or by separate agreements between us and the third parties who provide facilities for such payment mechanism.
You agree that the payment shall be your responsibility and you take all accountability or liability for defect or any issues in any payment procedure.
Any applicable taxes payable under law shall be paid and borne by you.

7. Check-in and Check-out

Standard check-in time would be 12:00 PM. A delay in check-in needs to be communicated to the us in advance to guarantee a booking of the rooms. A no-show at the time of Check-in and non-communication of delays may result in cancellation of the booking and the entire amount may be forfeited.
Standard check-out time would be 10:00 AM.
The room may be checked for any damage at the time of check-out.
Earlier check-in and late check-out may be permitted by Alkashray depending on the availability of the rooms and may be charged extra.
You shall be permitted to bring only as many guests allowed as per the room criteria and the Policy.
You are required to submit to us a valid government issued photo identification with address. You shall carry original government issued photo identification for the purposes of verification at the time of Check-in. You are also permitted to use Digi Locker app for the purpose of verification for photo identification. Bookings may be cancelled if you fail to provide the said photo identification with address. Bookings may also be cancelled in case incorrect documents are submitted. Acceptable ID proofs shall be any one of the following only:
- For Indian Citizens
  - Driver’s License
  - Passport
  - Aadhaar
  - Voter ID
- For Foreign Nationals
  - Passport It may be noted that no other forms of identification will be accepted by us.
You hereby permit us to keep a copy (whether in electronic form and/or physical form) of the photo identifications for security and record-keeping purposes.

8. Food and Beverages

You understand that we may also outsource catering services and the menus may be decided in advance. All meals are chargeable. You agree that every effort is made to use fresh ingredients in the preparation of food and beverages served at Alkashray. However, some food and beverages may have permitted artificial colorants, flavourings and preservatives. Any special meal requirements shall be pre-informed and communicated in the booking form or pre-informed at the time of check-in or any time after check-in but prior to the meal and may be available subject to discretion of Alkashray. Alkashray has large occupancy and is not able to accommodate individually tailored meals or menus for specific guests based on their individual dietary needs. We will try our best effort to provide preferred/individual meal requirements, but shall not be liable for any non-abidance of the preferred/individual meal requirements. It shall be your sole responsibility to observe any dietary restrictions as may be necessary and we shall have no liability for any illness, allergy etc. caused due to the same. The food is generally not served in the room and only in the common dining area. Outside food will be permitted and the guest/s not opting for meal options can carry their own food items and consumption of the same shall be at their own risk.

9. Cancellation and Refunds

If the booking is cancelled by you on the check-in date then “no refund” shall be granted and the amount will be forfeited.
If the cancellation is done by you 24 (twenty-four) hours before the check-in date, then only 0% of the amount paid therein shall be refunded.
If the cancellation is done by you between 24 -48 (twenty-four to fourty-eight) hours before the check-in date, then only 50% of the amount paid therein shall be refunded.
If the cancellation is done by you more then 48 (fourty-eight) hours before the check-in date, then “full amount” of the amount paid therein shall be refunded.
If the booking is cancelled by you on the check-in date then no refund shall be granted and the amount will be forfeited.
We reserve the right to cancel your booking at the time of check-in if in the opinion of Alkashray, we believe that you are not medically, physically or mentally fit. We shall refund 50% of the amount paid therein. You undertake to not raise any dispute or challenge of any kind.
All refunds shall be made to the original payment method within 30 (thirty) days from the receipt of said cancellation.
Any charges levied by the third party authorities for the transaction contemplated herein shall be borne and paid by you.
In the event of any complaints by the other guest, warnings will be issued not to create disturbances, subsequent to two warnings you will be asked to remove yourself from the premises immediately and no refunds shall be issued to you for the remaining period.
We reserve the right to cancel your bookings, at any time, without any liability, if in the sole opinion of Alkashray you have displayed an unpleasant or untoward behaviour towards staff and/or other guests and the balance amounts shall be forfeited.
Alkashray reserve the right to cancel your booking/s immediately at any time, without any liability, in the event you are suspected or found to be indulged in any act/omission which is against the interest of Alkashray or unethical, immoral or illegal in nature.

10. Rooms

The occupancy limit per room is two persons only.
A request in advance by phone call can be made for accommodating a third person in the room. However the same is not guaranteed and may be made available at the sole discretion of Alkashray.
Laundry services are provided at additional costs.
Linen, bed sheets, towels etc. shall be provided.
You are not permitted to change or tamper with the room’s furniture arrangement.
You are not permitted to affix any material on the walls, floors or ceilings of the room or alter the interiors of the room in any way.
You should always adhere to the safety, security and hygiene advice duly provided or intimated by us and should avoid breaching the same.
The luggage brought by you shall be at your sole risk and responsibility and Alkashray shall not be responsible at any time for any misplacement, loss, damage or theft of the same.
We reserve the right to enter the rooms in case of emergency, known or unknown or if we do not receive any response from you for a long time.
Pets of all types are strictly prohibited.
Consumption of tobacco, tobacco based products, cigars/cigarettes/beedi and alcohol is strictly prohibited, except in the designated area. Indulgence in any of the said activities shall be at your sole risk and responsibility and you shall be liable for any and all health related risks/hazards posed due to consumption of the above products. If any traces of the said products are found in your room then a penalty amounting to Rs. 2000/- (Rupees Two Thousand Only) per incident which may be charged or recovered from the incidental charges.
Weapons of all kinds are strictly prohibited. We reserve the right to remove you from the premises if you are found to possess any kind of weapon.

11. Damage to Property

Guests shall be liable to pay for any damage incurred by them to Alkashray’s assets or properties and the costs payable shall be at the discretion of Alkashray and the same shall be charged or recovered from the incidental charges. In the event the costs is less than the incidental charges then, Alkashray shall have the right to recover the same from you. Guests shall keep the room in a good condition, maintaining hygiene and cleanliness. Guests are not permitted to pluck leaves, flowers or fruits from the trees except with prior permission of Alkashray.

12. Privacy

We will maintain the privacy of all information provided by you. The said information shall only be used for official and internal purposes. However, the said information may be disclosed to any governmental/statutory/regulatory authority under applicable law if necessary. You expressly permit us to utilise your photos and/or videos captured at Alkashray or where Alkashray is tagged by you on your social media platforms for our promotional and/or marketing purposes.

13. Indemnity

You agree to indemnify and keep indemnified Alkashray, their respective officers, employees and agents, its independent service providers, third party suppliers and consultants from and against any and all losses, liabilities, claims, damages, demands, costs and expenses including legal fees asserted against or incurred by Alkashray that arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by you pursuant to this Policy. This clause and your obligations under this Policy will continue to be applicable even after you check-out from Alkashray.

14. Limitation of Liability

Representatives of Alkashray:

The management, employees, agents and representatives of Alkashray do not accept any liability whatsoever for any injury or death of any person or the loss or destruction of or damage to your property whether arising from any event, including but not limited to force majeure events.

Third Party:

We accept no responsibility or liability for any acts and/or omission and/or facilities or services provided by any third party agencies at Alkashray or for the purposes of availing the services of Alkashray, to you or the guest.

15. Force Majeure

Force Majeure shall mean conditions or events which cannot reasonably be forecasted or provided against, and which cannot be predicted by men of ordinary prudence or beyond the control of any party, like , an act of nature or terrorism, war, civil commotion, labour strike or lock-out, pandemic, epidemic, failure or default of public utilities or common carriers, or destruction of production facilities or materials by fire, earthquake, storm or like catastrophe. If it so happens that your check-in date coincides with a Force Majeure event, then your bookings shall automatically stand cancelled and appropriate amounts shall be refunded. You may be permitted to re-book after the Force Majeure event has passed and the same shall be treated as a new booking.

16. Health Related Provisions

You shall be solely responsible for your medicines and medical equipment/instruments, if any and its timely administration and its proper usage. We shall not be liable and/or responsible to provide, supply or furnish the same or provide any assistance related thereto.
We may only provide a basic first aid kit for your use, if required. It shall under no circumstance be construed as providing medical care of any kind.
You agree and understand that due to the geographical location of Alkashray, there are no specialist medical facilities and/or medical consultants and/or medical stores and/or transportation facilities available at Alkashray or in close proximity of Alkashray. We assumes no responsibility and or liability for providing any such services. By booking your stay with us you acknowledge, undertake and agree not to hold us and or our office bearers, agents or representatives responsible in any manner for providing such services or any shortcomings in any arrangements made, if any, and shall not make any claim and/or demand, whatsoever in nature, against us and or its office bearers, agents or representatives.
In the event you take any medicines and or treatment and or undergo any procedure at Alkashray either on your own, through or with assistance of any person including but not limited to any guest or representative or medical professional then the same shall be at your sole risks and responsibility and we and/or our office bearers, agents or representatives shall not be responsible and or liable in any manner including but not limited to for any mishaps, harm to you, deterioration of your health, death, injury, negligence, short comings etc.
You agree and understand that due to the geographical location of Alkashray, you may have to engage in physical activity which may be unusual or unaccustomed and you acknowledge, undertake and agree not to hold us and/or our representatives responsible in any manner for any consequences that may arise from the same and shall not make any claim and/or demand, whatsoever in nature, against us and/or our representatives.
You agree and understand that engagement in physical activity of any kind at Alkashray shall be at your sole risk and liability.

17 Visitor Policy

We, at Alkashray, desire to ensure that our guests/visitors feel the most contented. Therefore, following pointers are generally expected from you so that we can deliver excellent service and ensure the safety and security of you:

Please respect all members of staff, the fellow guests and any other person who finds him/herself in Alkashray.
It is forbidden to bring into Alkashray flammable materials, explosives or firearms. Bringing or storing any products/items of combustible or hazardous nature and/or prohibited goods and/or goods of objectionable nature is strictly prohibited and you may be removed from the premises of Alkashray.
Any Damage done to the amenities, articles, furniture, property., etc., by or due to you or your guest or any other person for whom you are responsible, you must pay and settle for such loss and damage in full as deemed appropriate by Alkashray.
It is not allowed to cause any disturbance to other guests nor cause any nuisance or annoyance in Alkashray premises. It is agreeably anticipated that guest will conduct themselves in a respectable, civilized and decent manner.
Using photographs and video’s taken in the Alkashray for commercial or a public purpose is illegal. Those who do so will be subject to prosecution.
Guest must have appropriate clothes and footwear when they are moving through the public spaces at Alkashray.

It is not allowed to take Alkashray property.

18. General

You shall be charged extra for the additional services availed by you during your stay at Alkashray.
In the event you lose any personal item in Alkashray, and is subsequently found by us, we may contact you for further action and if no reply is received, then we shall not be responsible for any loss or consequences arising therefrom.
You shall be responsible for all your belongings. We do not assume responsibility of any goods lost, stolen or misplaced whilst on our premises .
Alkashray is a private property and we reserve the right to refuse entry to any person for breach of any of the terms of this policy.
If You have any allergies, sensitivities or intolerance to, but not limited to a particular fabric, material, cleaning product or food, etc. it is your sole responsibility to inform us prior to arrival of the same. We shall not be liable for any adversities and health issues arising from the said allergies, sensitivities or intolerance.
You agree and understand that Alkashray is a habitat that has a lot of flora and fauna which might be dangerous and threatening to you. It is your duty to act in a diligent and prudent manner regarding your own safety and we take no responsibility for any accident and/or casualty from the same.
You agree and understand that due to the geographical location of Alkashray there might be concerns such as low-connectivity issues, range issues, internet speed issues, internet downtime etc. We take no responsibility for any losses and/or damage from the same.
You are not permitted to use or view or access any restricted areas at Alkashray.
The parking area is not supervised, and you are aware that you are leaving your vehicles in those places at your own risk and responsibility.

19 Drivers of Guest

All the terms and conditions of Alkashray shall be binding on your driver as well.
All services availed by such drivers shall be charged extra.
You need to make separate requests for accommodation of your drivers, subject to availability of adequate space in their resting area or common room. The request needs to be made at the time of booking only and may not be considered after your arrival.
You agree and understand that Alkashray is meant for seniors only and your drivers shall not be permitted within the premises of Alkashray.

20. Applicable Law

The courts at Pune shall have the exclusive jurisdiction to decide any dispute, difference, etc. between the parties.
This Policy shall be governed and construed in accordance with the laws of India.

I have read and understood the contents of the Policy and undertake to adhere by the same. I understand that the non-adherence of the same shall attract consequences and I shall be solely liable for the same.
